Welcome to the utility way. These Terms & Conditions (“Terms”) govern your access to and use of our website https://theutilityway.com/ (“the Site”) and any services, forms, programs, and communications offered by the utility way (“we,” “us,” or “our”) (collectively, the “Services”).

By accessing the Site or using our Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. 1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use our Services. By using the Site, you represent that you meet these requirements and that all information you provide to us is true, accurate, current, and complete.

2. About Our Services

2.1 Community Solar Information and Enrollment Assistance

The utility way provides information about community solar and helps connect individuals and businesses with community solar programs, solar farm operators, utilities, and related service providers (“Program Providers”). We are not a utility, and unless expressly stated otherwise, we do not own or operate the solar facilities you may subscribe to.

2.2 Third-Party Agreements

Any community solar subscription, energy contract, or other agreement you enter into is between you and the applicable Program Provider and is governed by that provider’s own terms. Please review those terms carefully before enrolling. We are not responsible for the acts, omissions, pricing, billing, or performance of any Program Provider.

2.3 Savings and Eligibility Are Not Guaranteed

Any savings figures, estimates, or examples shown on the Site or shared by our team are for illustration only. Actual savings depend on factors including your location, utility, usage, program availability, credit rates, and the terms of your subscription. Program availability and eligibility are determined by Program Providers and applicable regulations, and we do not guarantee that you will qualify or that any specific savings will be achieved.

3. Communications and Consent to Contact

When you submit a form on our Site, you agree that the utility way and its service providers may contact you by phone call and email at the phone number and email address you provide, regarding your request and related community solar services.

  • Consent is not a condition of any purchase.
  • You can opt out of emails using the unsubscribe link in any marketing email, or by contacting us at info@theutilityway.com.

We send text messages only if you separately check the optional SMS consent box. Text messages are governed by our SMS Terms and Conditions in Section 16 below.

You represent that you are the owner or authorized user of the phone number and email address you provide.

4. Green Energy Family and Agent Programs

From time to time we may offer referral, ambassador, or independent agent programs, including the Green Energy Family program (“Programs”). If you participate in a Program:

  • You must complete any required onboarding steps, such as training videos, questionnaires, and identity or document verification, and you agree that all information and documents you submit are genuine and belong to you.
  • Participation does not create an employment, partnership, or joint venture relationship with the utility way unless we agree otherwise in a separate written agreement.
  • Any compensation, rewards, or recognition (such as badges) are subject to the specific Program rules and any separate agreement we provide, and may be changed or discontinued at our discretion where permitted by law.
  • You must not make false or misleading statements about the utility way, community solar, savings, or any Program Provider, and you must comply with all applicable laws, including telemarketing, consumer protection, and privacy laws.
  • We may decline, suspend, or end your participation if you violate these Terms or Program rules.

5. Information and Documents You Submit

You are responsible for the information, documents, and images you submit through the Site, including identification documents. You agree not to submit information that is false, belongs to someone else without their authorization, or that you do not have the right to share. We handle the personal information you submit as described in our Privacy Policy.

6. Acceptable Use

You agree not to:

  • Use the Site for any unlawful, fraudulent, or deceptive purpose.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the Site, its servers, or networks, or attempt to gain unauthorized access to any part of the Site, including restricted or administrative areas.
  • Upload or transmit viruses, malware, or other harmful code.
  • Use automated means (such as bots or scrapers) to access or collect data from the Site without our written permission.
  • Share any private links, access codes, or credentials we provide to you with anyone else.

7. Intellectual Property

The Site and its content, including text, graphics, logos, images, videos, training materials, and software, are owned by or licensed to the utility way and are protected by copyright, trademark, and other laws. You may view and print content for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

The Site may contain links to third-party websites, including social media pages and Program Provider sites. These links are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of any third-party site, and your use of them is at your own risk.

9. Disclaimer of Warranties

The Site and Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is complete, accurate, or current. Content on the Site is for general informational purposes and is not legal, financial, or tax advice.

10. Limitation of Liability

To the fullest extent permitted by law, the utility way and its owners, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, savings, data, or goodwill, arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to these Terms or the Services will not exceed one hundred U.S. dollars (US $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify and hold harmless the utility way and its owners, employees, agents, and partners from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or Services, your violation of these Terms, or your violation of any rights of another person.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at info@theutilityway.com so we can try to resolve the dispute informally. If a dispute is not resolved within 30 days, it will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to the jurisdiction of those courts.

13. Changes to the Site and These Terms

We may modify, suspend, or discontinue any part of the Site or Services at any time. We may also update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.

14. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy and any Program-specific rules, are the entire agreement between you and us regarding the Site.

16. SMS Terms and Conditions

16.1 Introduction

Welcome to The Utility Way. By accessing or using our services, including receiving SMS communications, you agree to these Terms and Conditions. If you do not agree, please do not opt in to receive SMS messages from us.

16.2 Program Description

When you opt in, you agree to receive text messages from The Utility Way related to customer care and your community solar request, such as replies to your inquiries, appointment and follow-up reminders, and updates about your enrollment.

16.3 How to Opt In

You can opt in by checking the SMS consent box on the form on our Contact Us page and submitting it. Consent to receive SMS messages is optional and is not a condition of any purchase.

16.4 How to Opt Out

You can cancel the SMS service at any time. Just text STOP to the number that messaged you. After you send STOP, we will send you one final message confirming that you have been unsubscribed, and you will no longer receive SMS messages from us. If you want to join again, simply sign up as you did the first time and we will start sending messages to you again.

16.6 Message Frequency and Rates

Message frequency varies. Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, please contact your wireless provider.

16.7 Carrier Liability

Carriers are not liable for delayed or undelivered messages.

16.8 Privacy

SMS consent is not shared with third parties for marketing purposes. No mobile opt-in data will be shared with third parties for marketing purposes. For more information, please see our Privacy Policy.

16.9 Eligibility

You must be at least 18 years old, and the account holder or authorized user of the mobile number you provide, to opt in to SMS messages.

16.10 Changes to These SMS Terms

We may update these SMS Terms from time to time. Any changes will be posted on this page with an updated effective date.
